What is involved in applying for probate?

A Grant of Probate is a document issued by the Supreme Court of Western Australia affirming the validity of a deceased’s Will and giving an executor authority to deal with the deceased’s estate. In most cases, making an application for a Grant of Probate is the first step in administering a deceased’s estate.

Documents required:

  • the original Will;
  • the original death certificate; and
  • a simple checklist provided by us.

An application for a Grant of Probate is made by an executor named in the Will. You must wait 14 days before filing an application with the Court.

In order to apply for a Grant of Probate in Western Australia, the deceased person must have left some property in Western Australia.

Applying for a Grant of Probate involves preparing a straightforward affidavit sworn by the executor, which contains information taken from the Will and death certificate. An application also requires an executor to provide the court with a statement of the assets and liabilities that the deceased held at the date of their death. These include but are not limited to: real estate, bank accounts, share, superannuation or life insurance and retirement village/nursing home refunds.
